The following page are the complete terms of service when ordering a commission from Vaughn. By proceeding with the commission order, you hereby agree to the following commission terms and understand that, as per business practices, the terms are legally binding. By agreeing to the terms, you also acknowledge that, should you break any of the conditions listed, you forfeit your right to the ordered commission and that Vaughn may choose to blacklist you from further work with him.

General terms.

• The following terms apply to NON-COMMERCIAL artworks only. If the commissioner is seeking art for a commercial enterprise, it is required to go through professional avenues, including, but not limited to, hiring as part of your company's team. You can find the details regarding this on the contact page.

• The digital signature and watermark must remain on any future uploads of the finished commission. If a physical print is purchased, the signature can be removed upon request. A personally made signature and/or custom message to the commissioner can be added to a physical print if requested.

• The commissioner will be supplied two previews in the sketching stage of the project, in which they can request edits. Any alterations made after the previews will incur costs for the commissioner to accomodate for the extra time that will be required to complete the art piece.

• Commission prices are allocated for art pieces that include one (1) character. Any further characters to be added, or highly intricate detailing in the art piece, may incur a larger price for the commissioner. This will be discussed before the final invoice will be sent.


Payment terms.

• All payments must be made in AUD via the invoice that is supplied through PayPal. It is up to the commissioner to accomodate for exchange rates and to ensure that the correct amount is paid. Payments sent outside of the supplied invoice will be refunded and the corresponding commission will be cancelled, and the commissioner will be blacklisted.

• Payment is required to be paid in full upon the commission being accepted, unless the total fee is over 200 AUD. In this case, it is permitted to pay a 50% up-front fee at the commencement of the commission, followed by the final 50% at completion. In the event that the commissioner chooses to pay in installments, ownership of the commission and final copy of the art will not be supplied to the commissioner until the final payment is made, totalling to the prior agreed amount.


Subject matter

• If the commissioner is requesting art that is NSFW in nature (sexual, fetish, kink, nudity, etc), the commissioner will be required to supply documentation stating that they are over the age of 18. This includes, but is not limited to, a driver's license in their country of origin or a passport, including photographic evidence that they are the owner of said documentation. If, at any point, there is suspicion that the commissioner is not over the age of 18, the commission will be forfeited and the commissioner will be blacklisted. This evidence is only used for verification, and will not be stored or otherwise used.

• Any commission detailing imagery which is racist, homophobic, transphobic or discriminates along the axes of culture, gender or religion or is otherwise hateful will be instantly declined. This is non-negotiable.

• Commissions will only be accepted for characters that the commissioner personally owns the rights to, has explicit written permission for, or exists within a fandom where the copyright law of transformative works would take effect.

• Vaughn is capable of illustrating almost every race or species; fantasy, real life or mechanical. However, some commissions may be refused on the basis of subject matter due to personal discomfort or skill level. As such, Vaughn is permitted to decline any commission without reason, however will likely supply a reason out of courtesy.


Copyright and commercial rights.

• By commissioning Vaughn, you are paying for labour and skill only.

• Upon completion of the commission, Vaughn retains all rights, copyright and commercial, to the finished art product. This includes, but is not limited to, full use of the art on Vaughn's personal art galleries and portfolios, both online and offline, and in the replication of the commission for further commercial means, such as merchandise.

• As a result of this, the commissioner may not replicate, reproduce, trace, alter the commission in any capacity, or otherwise claim as theirs. Personal online use of the commissioned art may be allowed as long as it falls under the following; personal avatar on social media accounts or websites or portfolios used for 'original character' tracking and detailing. Any other personal online uses not mentioned here will be discussed on a case-by-case basis. All uploads of the commissioned art to online spaces, however, must provide credit to Vaughn and link to one of the appropriate social media, or this portfolio.

• Commercial use, profit or distribution of the commissioned art, regardless of details, is disallowed.


Refund policy.

• If the commissioner is dissatisfied with the quality of the art received, they have seven (7) days from receiving the final commission to initiate contact to rectify the situation. If contact is not made within those seven (7) days, the art received and payment made is final.

• The commissioner changing their mind or otherwise personally disliking the final product are not grounds for a refund. Quality dissatisfaction (including, but not limited to, instances of low image quality and the commission being unlike supplied art style examples) may be discussed between the commissioner and Vaughn pertaining to a refund or alteration.

• Full refunds will not be supplied for completed digital commissions. From there, refunds will be issued on a case-by-case basis, determined from the amount of work completed, reasons for refunding and time since the commission was placed.

• If a physical copy of the commission is damaged, lost or otherwise stolen during postage to the commissioner, the fee associated with the physical print shipment will be fully refunded. As the commissioner will still be in possession of the digital copy of the art, it is only the fee associated with the physical print that will be refunded.
